TERMS + CONDITIONS

Services:

1. Complimentary Replacements: Avon Safe includes unlimited replacements for faulty standard light switches, standard power points, and standard safety switches. Any replacements or repairs involving non-standard power points, switches, or any lighting fixtures will be subject to a separate quotation.

2. Gas Appliance Inspections: Avon Safe includes an inspection of up to three (3) gas appliances at no additional charge. Each additional gas appliance inspection beyond the initial three (3) will incur a fee of $80.00 plus GST per additional appliance.

3. Exclusions & Additional Charges: Any repairs, replacements, or services not specifically covered under this agreement, including but not limited to non-standard electrical or gas components, parts or appliances will be quoted separately and require approval before proceeding.

Rectification Work:

Avon Safe shall not be obligated to undertake any rectification works. However, Avon Safe may provide a quotation for such works. Avon Safe reserves the right, at its sole discretion, to withdraw or cancel any accepted quotation without liability.

Avon Safe shall not be liable for any rectification works following the capping of the mains gas supply or specific appliance in the event that a gas leak is detected. Upon identification of a gas leak, Avon Safe will promptly notify the Property Manager or Rental Provider, who shall be responsible for coordinating any necessary repairs.

Furthermore, Avon Safe shall not be responsible for updating any reports following the completion of rectification works. The purpose of the report is to identify and highlight any existing safety or non-compliant issues at the time of inspection only. Upon completion of any rectification works, it shall be the sole responsibility of the tradesperson or company employed to provide the appropriate proof of the work performed to the Rental Provider or Property Manager.

Invoicing and Payment Terms:

· For properties managed by a Real Estate Agency or a Property Manager, Avon Safe shall issue invoices within thirty (30) days of the scheduled safety check appointment. Payment for services shall be processed by the Real Estate Agency via rental income.

· For properties not managed by a Real Estate Agency, Avon Safe shall issue invoices directly to the Rental Provider. In such cases, payment must be received in full prior to commencement of any services. Avon Safe reserves the right to withhold services until payment is received in full.

· For Packaged Subscription, a minimum contract term of twenty-four (24) months applies. The total service fee is payable in two (2) annual instalments. The first instalment shall be due and payable upon commencement of the service term (“Year 1”), and the second instalment shall be due on the date that is twelve (12) months from the commencement date (“Year 2”). For clarity, the minimum term is fixed upon commencement of any services, and the full service fee remains payable in full over the two instalments, irrespective of property sale, service usage, or early termination.

· Avon Safe may charge penalty interest on overdue invoices at a rate of 10% per annum calculated daily from the due date until payment is received.

· Avon Safe reserves the right to terminate or suspend services immediately and without liability where there has been failure to provide reasonable access to the property; unauthorised modification or tampering with appliances or installations; or material misrepresentation

Complimentary Smoke Alarm Call-Outs:

Avon Safe shall provide complimentary call-out services for smoke alarms within three (3) months following the completion of services conducted by Avon Safe. This provision applies exclusively to services performed by Avon Safe and does not extend to issues arising from external factors, tampering, or work conducted by third parties. Complimentary call-outs do not cover smoke alarm malfunctions or issues arising from power outages, including instances where the property has been unoccupied for an extended period, or other circumstances beyond Avon Safe’s control.

Multiple Property discounts:

Avon Safe shall apply a discount of ten percent (10%) for any additional properties when a minimum of two (2) properties are enrolled. This discount shall be applicable exclusively to the second and any subsequent properties and shall not be applied to the first enrolled property. by the customer.

Cancellation Terms:

Pay As You Go: To cancel a Pay As You Go service, the customer must submit a cancellation request at least thirty (30) days prior to the scheduled service commencement date by contacting Avon Safe at contact@avonsafe.com.au

Refunds: A refund shall only be issued if the cancellation request is made before the commencement of any services.

Packaged Subscription: To cancel a Packaged Subscription, the customer must submit a cancellation request at least thirty (30) days prior to the subscription renewal date by contacting Avon Safe at contact@avonsafe.com.au.

Refunds: A refund shall only be issued if the cancellation request is made before the commencement of any services.

Partial Refunds: Avon Safe does not provide partial refunds for any unused portion of the subscription.

Automatic Renewal: The Packaged Subscription shall automatically renew at the end of the twenty-four (24) month term unless the customer submits a cancellation request at least thirty (30) days prior to the renewal date.

Limitation of liability:

Avon Safe shall not be liable for:

· Any rectification works performed by third parties following inspections

· Delays or interruptions to services due to events beyond Avon Safe’s reasonable control (including force majeure events, inclement weather, supply chain issues etc.).

· Incidental or consequential damage arising from inspections or services provided under this agreement.

· Defects, malfunctions, or failures of appliances or systems that arise from fair wear and tear, age, or pre-existing conditions; and

· Damage or issues caused by actions, inactions, omissions, or negligence on the part of tenants, property occupants, or third parties engaged by the customer.

General Terms:

Avon Safe reserves the right to modify these terms at any time.

Avon Safe provides no warranty on performance beyond what is expressly included in this agreement and as required under Australian Consumer Law. Nothing in these terms is intended to limit or exclude any rights of customers under Australian Consumer Law.

This agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral.
